Recientemente, el empresario del transporte y actualmente senador de la alianza Fuerza del Pueblo (FP) – Partido Revolucionario Moderno (PRM) por la provincia Santiago Rodríguez, Antonio Marte, depositó una denuncia en la Procuraduría General de la República solicitando que se investigara a funcionarios del pasado gobierno por prevaricación y corrupción, entre ellos a mi persona.
En la denuncia se hace referencia a que estos funcionarios usaron diecisiete mil millones (RD$17,000 millones) en el “programa ilegal de asfalto”, cuando debieron ser utilizados por el INTRANT para el desarrollo vial y el cambio o reestructuración de la flotillas del transporte deterioradas.
Los recursos a los que hace referencia el empresario del transporte y senador Antonio Marte en su denuncia provienen de la recaudación de un impuesto de RD$2.00 por galón de gasolina o gasoil regular o premium establecido en el Artículo 20 de la Ley Núm. 253-12:
- En su Párrafo III indica que “el veinticinco por ciento (25%) de estos ingresos deberá ser utilizado exclusivamente para el programa de renovación vehicular de transporte público de pasajeros y de carga, cuyo diseño deberá ser coordinado con los representantes del sector transporte. El setenta y cinco por cierto (75%) restante será utilizado para el desarrollo vial”.
- En su Párrafo I recoge que este impuesto será recaudado por la Dirección General de Impuestos Internos (DGII).
- En su Párrafo II establece que “la recaudación estimada por este concepto será asignada en el Presupuesto General del Estado. El Ministerio de la Presidencia coordinará la utilización de dicho fondo e identificará los programas y proyectos a ser financiados”.
De manera específica, sobre los fondos correspondientes al 25% mencionado, la Ley Núm. 63-17 sobre Tránsito, Transporte y Seguridad Vial establece en el Artículo 20 lo siguiente: “Estos fondos serán utilizados exclusivamente para el programa de renovación vehicular del transporte de pasajeros y cargas, cuyo diseño y regulación estará a cargo del INTRANT”.
A partir de estas informaciones, y en respuesta a la denuncia, divorciada de la realidad y totalmente falsa, expreso lo siguiente:
- Desde diciembre de 2012 hasta agosto de 2020, cuando concluyó la pasada gestión de gobierno, el 25% del monto recaudado por el impuesto selectivo adicional al gasoil y la gasolina ascendió a RD$2,592.2 millones. El 75% restante del monto recaudado fue de RD$7,776.6 millones. El total ascendió a RD$10,368.8 millones. Es falso, por tanto, que se dispusiera de un fondo de RD$17,000 millones para la flotilla del transporte, como ha señalado el empresario del transporte y senador Antonio Marte.
- En su denuncia, el senador Antonio Marte cita una supuesta comunicación del Ministerio de Hacienda del actual gobierno, la SAIP –SIP-000-40008/DAIP, de fecha 2 de septiembre de 2020, que ofrece unos datos sobre recaudaciones por dicho impuesto muy superiores a los que tiene publicados la Dirección General de Presupuesto (DIGEPRES) en su página web y a los que se pueden estimar a partir del consumo mensual de combustibles publicado por la Dirección General de Impuestos Internos (DGII). Sería importante entender por qué existe esa diferencia.
En la supuesta carta, se menciona que en los primeros ocho meses (enero-agosto) de 2020, hubo una recaudación de RD$2,911.6 millones por dicho impuesto. Sobre ello cabe decir lo siguiente:
- Esta sería la cifra más elevada obtenida en todos los años desde 2012, extrañamente en un año donde el consumo de gasolina y gasoil cayó en casi un 20% debido a la pandemia.
- Este dato es todavía más llamativo al comprobar que la propia DIGEPRES registra en su página web que se recaudaron RD$946.9 millones por concepto de los RD$2/galón de impuesto a los combustibles para el período enero-agosto de 2020.
- Los recursos recaudados por el impuesto de RD$2 por galón y que correspondían al 25% para fines de renovación de flotilla vehicular fueron depositados de manera íntegra en el Fondo 2073 de la Tesorería Nacional y nunca fueron utilizados:
- En dicho Fondo, hasta el 10 de agosto de 2020, había RD$2,552.4 millones disponibles. Este monto se obtiene al restarle a los RD$2,592.2 millones recaudados, según lo reportado por la DIGEPRES, unos RD$39.8 millones correspondientes a rezagos de reportería en la recepción de estos fondos por la Tesorería Nacional. Este rezago, inferior al 2% del total, se normaliza al final del año cuando se realiza el cierre de las cuentas presupuestarias.
- Ni el Ministerio de la Presidencia ni el INTRANT, instituciones dispuestas por las leyes 253-12 y 63-17, respectivamente, para coordinar la utilización de dichos fondos, ejecutaron gastos con ellos. En otras palabras: durante el gobierno de Danilo Medina estos recursos nunca fueron usados ni desembolsados.
Por lo tanto, es una temeridad e irresponsabilidad decir que estos recursos fueron gastados por las pasadas autoridades, pues los mismos permanecían en un fondo especializado de la Tesorería Nacional (2073) a la salida del gobierno anterior.
- Los recursos recaudados por el impuesto de RD$2 por galón y que correspondían al 75% para fines de red vial fueron depositados de manera íntegra en el Fondo 2075 de la Tesorería Nacional. De este fondo, se efectuaron retiros para diferentes obras viales. Estos gastos fueron aprobados por las respectivas leyes de Presupuesto General del Estado, y su ejecución fue realizada por las instituciones que recibieron las apropiaciones indicadas de acuerdo a lo dispuesto por el Párrafo IV del Artículo 20 de la Ley Núm. 253-12 cuando dice que “la administración y uso de estos recursos está sometida al sistema de control interno y externo previsto por las leyes dominicanas, así como al régimen de contrataciones públicas”.
En conclusión, los recursos derivados de la recaudación del impuesto de RD$2/galón correspondiente a la proporción destinada para la renovación de la flota vehicular fueron acumulados y preservados intactos, recibiendo la admiración del nuevo gobierno, en la cuenta 2073 de la Tesorería Nacional.
Lo que el senador Antonio Marte y quienes le acompañan en la denuncia presentada en la Procuraduría General de la República están llevando a cabo es una burda y malintencionada manipulación de la opinión pública con el vil fin de dañar reputaciones a través del juicio mediático y social.
