A Jean P. le han echado por trabajar más de la cuenta. Hasta el pasado junio, Jean era el gerente de una tienda de los supermercados Lidl en Barcelona. Pero la empresa descubrió su terrible pecado: resulta que el hombre empezaba a trabajar antes de tiempo –a veces llegaba incluso con una hora de antelación– para “preparar la tienda antes de su apertura al público”. Sin haber fichado siquiera, Jean “realizaba pedidos, cambiaba precios o reponía palés enteros de artículos”, según consta en su carta de despido.1508916128_096755_1508943961_noticia_normal_recorte1

Lidl despidió a Jean por “incumplimientos laborales muy graves” tras una investigación que llevó a la multinacional alemana a revisar las imágenes de seguridad del supermercado. Durante unos días de abril de 2017, la empresa observó cómo el gerente accedía al local a las cinco de la mañana y pasaba un buen rato -«entre 49 y 87 minutos”, dice el informe- trabajando sin fichar. Al hacerlo así, Jean vulneró la norma por la cual “cada minuto que se trabaja, se paga, y cada minuto que se trabaja debe quedar registrado”, recoge la carta de despido. Lidl agrega que recibió “quejas” de empleados a los que también invitaba a llegar antes. Además, en muchas ocasiones el gerente estaba solo, algo que también está prohibido por motivos de “seguridad”.

Jean, que trabajaba en Lidl desde 2005, cree que su despido es improcedente y ha llevado a la cadena de supermercados ante los tribunales para que le readmita. Este miércoles se ha celebrado el juicio. El hombre alega que nunca obligó a ningún empleado a acompañarle para abrir el supermercado. Y que la empresa en ningún momento le indicó que no podía acudir “un poco antes para preparar la tienda y poder afrontar eficazmente la apertura”, recoge la demanda. Su abogado, Juan Guerra, recuerda que si Jean se apartó de los procedimientos no fue “precisamente” en su provecho, sino “en beneficio de la empresa”.

“Curiosamente se le sanciona, lo que desde luego no es usual, por trabajar demasiado y esforzarse en que su tienda funcionara correctamente”, lamenta el abogado, quien añade que su cliente jamás fue amonestado ni sancionado por ello. Jean va más allá y denuncia la “hipocresía” de la empresa porque, según denuncia, sí le sometía a “presiones para conseguir las ventas que esperaba la dirección”.

El gerente avisa, además, de que trabajar más de la cuenta tampoco era algo habitual. Se vio obligado por las circunstancias. Los días previos a los investigados por la empresa, se había acometido la reestructuración de la tienda. “Los mandos sabían y eran conscientes” de que esos cambios “requerían tiempo y dedicación”, sostiene la demanda. Para cumplir los objetivos de ventas, agrega, «a veces hay que trabajar por encima del horario».
